SOUR Energy is a lifestyle and energy brand focused on nicotine-free, tobacco-free, sugar-free energy pouch products, apparel, and related brand experiences.

Product availability, launch timing, flavors, caffeine amounts, packaging, pricing, rewards, and promotions may change before launch or after launch.

We try to make product descriptions, images, flavors, caffeine information, claims, pricing, and availability accurate. However, we do not guarantee that all content is error-free, complete, current, or available at all times.

SOUR Energy products may contain caffeine. They are not recommended for children, pregnant or nursing individuals, or people sensitive to caffeine. Use responsibly.

Joining the waitlist does not guarantee product availability, early access, free products, discounts, referral rewards, or the ability to purchase. Waitlist access may be limited, delayed, modified, or closed at our discretion.

You agree to provide accurate information when joining the waitlist. We may remove duplicate, fraudulent, invalid, or abusive entries.

Referral rewards, SOUR Credits, milestones, discounts, or free product rewards may be offered from time to time.

Referral rewards have no cash value, are not transferable, and may be changed, paused, limited, or discontinued at any time. We may remove referrals or rewards connected to fraud, spam, abuse, fake accounts, duplicate accounts, or other activity that violates these Terms.

Submitting a partner, athlete, ambassador, retailer, wholesale, or sampling form does not create a partnership, employment relationship, agency relationship, sponsorship, endorsement deal, wholesale account, or ambassador agreement.

Any partnership, sponsorship, ambassador, affiliate, wholesale, or retail relationship must be separately approved by SOUR Energy and may require a written agreement.

By submitting a form, you give SOUR Energy permission to contact you using the information you provide.

If SOUR Energy offers reservations, deposits, or preorders, the applicable page will describe the terms at the time of submission or purchase.

• —A free reservation does not charge you and does not guarantee product availability.
• —A refundable deposit, if offered, holds your place according to the terms shown at the time of deposit.
• —A preorder, if offered, will include an estimated shipping window when required. If shipping timing changes materially, SOUR Energy will provide options consistent with applicable rules, which may include delay consent or refund options.

If Shopify checkout is enabled, purchases may be processed through Shopify and related payment providers. Shopify and payment providers may have their own terms, privacy policies, payment rules, fraud controls, and checkout requirements.

SOUR Energy may accept, decline, cancel, refund, or limit orders where permitted, including for suspected fraud, payment issues, inventory issues, incorrect pricing, shipping restrictions, age concerns, or policy violations.

Shipping, returns, refunds, preorder timing, deposits, and order policies may be posted separately at checkout or on the website. Those policies are incorporated into these Terms when published.

If you submit photos, videos, reviews, comments, social media tags, testimonials, ideas, feedback, or other content to SOUR Energy, you confirm that you have the right to submit it.

You grant SOUR Energy permission to use, reproduce, display, edit, repost, publish, and share submitted content for marketing, social media, website, email, and brand purposes, unless otherwise prohibited by law or agreed in writing.

Do not submit content that is illegal, misleading, infringing, abusive, defamatory, obscene, unsafe, or violates the rights of others.

The SOUR Energy name, SOUR ENERGY™, logos, designs, graphics, icons, images, product names, flavor names, website content, apparel designs, packaging concepts, taglines, and related brand assets are owned by SOUR Energy LLC or its licensors.

You may not copy, reproduce, sell, modify, distribute, display, use, or exploit SOUR Energy intellectual property without written permission.

You agree not to:

• —Use the website for illegal, fraudulent, harmful, or abusive activity.
• —Submit false, misleading, duplicate, or fraudulent information.
• —Attempt to interfere with the website, CRM, referral system, email system, checkout, or security.
• —Scrape, copy, reverse engineer, or misuse site content or data.
• —Use SOUR Energy branding without permission.
• —Violate applicable laws, regulations, third-party rights, or these Terms.

The website may link to third-party websites or services, including Shopify, social media platforms, analytics providers, payment processors, and other tools. We are not responsible for third-party websites, policies, content, availability, or practices.

The website and services are provided on an "as is" and "as available" basis. SOUR Energy does not guarantee uninterrupted access, error-free operation, specific results, product availability, launch timing, referral rewards, or compatibility with every device or browser.

To the fullest extent permitted by law, SOUR Energy LLC and its owners, officers, employees, contractors, partners, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of the website, products, services, waitlist, referral program, partner forms, or third-party services.

You agree to defend, indemnify, and hold harmless SOUR Energy LLC and its owners, officers, employees, contractors, partners, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the website, violation of these Terms, violation of law, or violation of third-party rights.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
